Head of Household?

I was divorced in August last year. I was the non-custodial parent of my children throughout 2007. In my divorce settlement it states that I shall be entitled to claiming the children as exemptions. Looks like I am phased out of getting any credits, but can I claim Head of Household based on what the settlement says, or does this have nothing to do with it.
